KNOWN ALL MEN BY THESE PRESENTS:
This contract is made and executed by and between the municipal government of Larena, province of Siquijor, hereinafter called the FIRST PARTY, and the SECOND PARTY.
That the FIRST PARTY is operating a water system known as the Larena Waterworks System.
That the SECOND PARTY is a water consumer served under the operation of the Larena Waterworks System and classified herein as Residential/Commercial water consumer per Ordinance No. 08, series of 2020 of the Municipality of Larena, province of Siquijor.
The SECOND PARTY shall use a water meter provided by the FIRST PARTY upon payment of a water meter fee during application. If no meter is available, the applicant shall provide their own meter.
The SECOND PARTY shall pay to the FIRST PARTY a monthly fee based on the following schedule:
For businesses indirectly using water in daily operations:
For businesses directly using water meters daily, such as water refilling stations:
The rate shall begin to accrue upon installation of water service connection and is subject to change as the FIRST PARTY may require by resolution or ordinance.
The SECOND PARTY must replace a lost or damaged water meter within one month. Failure to do so will result in service disconnection and forfeiture of the meter fee.
Pending replacement of the meter, the SECOND PARTY shall pay a fee equivalent to the highest consumption over the past six months.
The SECOND PARTY must inform the municipal government of meter loss or damage within 24 hours. Failure to report may result in service disconnection.
The FIRST PARTY shall not be responsible for service interruptions due to causes beyond its control.
The SECOND PARTY shall allow authorized personnel to enter premises for official duties related to water service.
The SECOND PARTY shall maintain proper installation and agrees not to tamper or make unauthorized sub-connections.
If the SECOND PARTY is a lessee, the owner of the property shall be liable for any delinquent water bills.
The FIRST PARTY reserves the right to disconnect service for repairs, non-payment, fraudulent practices, or lack of maintenance.
All other pertinent provisions of Ordinance No. 08, series of 2020, shall form part of this contract.
Any breach of Ordinance No. 08, series of 2020, shall warrant termination of water service without prejudice to Article XVI of the ordinance.
